TEMPO Interactive, Jakarta:The Indonesian Employers Association (Apindo) rejects the implementation of the International Labor Organization (ILO) convention concerning domestic workers in Indonesia.

They argue that house maids in Indonesia are regarded as family. Using a contract would complicate arrangements, said Sofjan Wanandi, the Apindo chairman, at his office on Friday last week.

Sofjan worries that if the convention was implemented, the rules will only harm workers because employers will find it easier to break the contractas in the case of labor outsourcing recruitment.

In addition, domestic workers in Indonesia usually stand by at their employers house for 24 hours. How will the [employers] pay for such overtime then? said the CEO of Gemala Group.

However, Sofjan supports the implementation of the law overseas. Because protection is needed, he said.

The standard system for domestic workers was discussed during the ILOs 100th commeration in Geneva, Switzerland, last week. The organization determined that domestic workers should have the same rights as other workers.

Among some of the points, domestic workers must have reasonable working hours and a weekly holiday for a minimum of 24 consecutive hours. Workers must also be clearly informed on the working terms and conditions as well as their right to freedom of association for collective bargaining.

Suhartono, the Manpower and Transmigration Ministry spokesman, said that the government does not have the number of domestic workers because there is no official regulation on recruitment of domestic workers.

Domestic workers are employed under contract based on kinship, and, therefore, never registered as job seekers. Suhartono asserted, however that the government pays attention to their protection.

The problem is that domestic work is not included in the category of Law No. 13/2003 on Manpower. The law is only intended for registered workers.

As a result, any violation on the rights or obligations of the domestic workers are settled by the police. Suhartono said that the government has yet to confirm if the Convention on Domestic Workers will be ratified or not.

The convention has just been agreed. First, the ILO must socialize it to its member countries, he said.

Suhartono admitted that the Convention on Domestic Workers provides domestic workers with legal certainty. But, the convention failed to take into account the existing culture in which domestic workers are employed, many of which are based on kinship instead of a rigid contract system.
